Conservation Commission
Meeting
June 2, 2005

Hank Langstroth, Stephan Glicken, Stephen Cremer, and Janet Dunlap were the members present. Chairman Peg Arguimbau, arrived at 7:50 p.m.

Hank Langstroth was Acting Chairman at this time.
Hank opened the meeting.

7:45 p.m.: The Planning Board to discuss an Affordable Housing Plan with the Commission:

Present: Planning Board Member Eli Hauser and Jane Desberg, Executive Director of the Housing Authority and representing the Housing Partnership.

Eli Hauser requested feedback from the Commission regarding the Affordable Housing parcels previously proposed by the Planning Board. He explained to the Commission that the Planning
Board has no allegiance to a particular parcel.
Hank stated that results from the Commission’s review of the proposed parcels were inconclusive regarding several lots. The Commission has not considered any additional parcels.

Chairman Peg Arguimbau arrived at this time.
The Commission reviewed the list of the proposed Affordable Housing parcels with Eli Hauser and Jane Desberg:

Parcel No. 039095000 - 195 Wolomolopoag Street.
The Commission agreed that Parcel No. 039095000, the northernmost lot adjacent to the cul-de-sac, might be a possible location for an affordable housing site conditional upon subdivision approval.

Parcel No. 063014000 – 156 Mountain Street by Heather Way.
Peg explained that this is an open space parcel for the Hampton Estates Subdivision.
The concerns of the Commission were as follows:
The parcel is adjacent to a previous Town Dump.
Abutting wetlands at the right- rear section of the lot.
The construction of a common driveway, as opposed to a roadway, would be a requirement of the Commission if this parcel were allowed for affordable housing.

Parcel No. 074019001 – 26 Oak Hill Drive. (Former Nudist Colony)
The Commission agreed that this southernmost lot accessed from Hampton Road might be a possibility for affordable housing conditional upon subdivision approval.

Parcel No. 079001000 -  45 Sandy Ridge Circle.
The Commission expressed the following concerns:
Groundwater Protection District.
The entire parcel is located in Zone 2.
Steep slopes.
Wetlands.
Sandy Soil.
Not Accessible.
Unable to construct a roadway on existing sandy soil.

The Commission determined that this parcel is not suitable for housing.

Parcel No. 091011000 –  25 Pleasant Park Road.

The Commission agreed that this northernmost lot might be a possible location for housing conditional upon stricter septic regulations. (There are not too many slopes on the lot.)  

Exchange Parcel
Parcel No. 023002000 – 71R Mansfield Street.

This parcel abuts the King Philip’s Rock project.
Access by the cul-de-sac on King Philip’s Road would be a requirement of the Commission if this parcel were to be allowed for affordable housing.

Exchange Parcel
Parcel No. 040033000 - (At the bend of East Foxboro Street.)
This parcel is listed on the map submitted by the Planning Board as Town owned; however, the Commission already owns this parcel.
The Commission agreed that this parcel should not be considered for the land swap because the Commission owns it.

Conservation Commission Owned
Parcel Numbers: 001013000 - 001014000 - 001015000 (340, 348, 356 Mansfield Street - Donated lots.)

The Commission agreed not to consider these parcels due to a previous vote to not release donated parcels.

Conservation Commission Owned
Parcel Number 023027000 - 229 Lakeview Street.

The Commission acquired this large substantial portion of contiguous wetland bordering
Lake Massapoag from the Horizons for Youth Subdivision.
The Zoning Board of Appeals approved the Subdivision under a special permit.

(Proposed housing between Eagle Drive and Owl Drive behind campgrounds.)

The Commission expressed the following concerns:
Proximity to Lake Massapoag.
Parcel is located within the Surface Water Protection District.
Septic system issues.
Elevation issues.
Conditional upon subdivision approval.  

The Commission agreed not to consider this parcel for housing.

Parcel Number 029007000 – 000 Furnace Street & 100 Gavins Pond Road.

The Commission expressed the following concerns:
The Restrictions of the Buffer Zone on the middle two lots is an issue.
Proximity to Town Well Numbers 5 & 7.

The Commission determined that this parcel might be a possible location for housing conditional upon sewer connection to the Town of Mansfield. (Two lots from the bottom of the parcel and one lot from the middle of the parcel surrounding the cul-de-sac.)

Parcel Number 074074000- 74 Aspen Road.

The Commission agreed that this southernmost lot located on the bend of Oak Hill Drive might be a possible location for housing conditional upon subdivision approval and wetland permitting.

Conservation Commission Owned
Parcel Number 119043000 – 90 Maskwonicut Street. (Goldenwood Subdivision) Jenkins is the owner.

The Commission expressed the following concerns:

The Commission feels that the Planning Board, in error, proposed this parcel because a house already exists on the two proposed lots.
The Commission determined that this parcel should not be considered for housing.

Parcel Number 131001006 – 149 Edge Hill Road. - Donated Lot.
(Stream by Edge Hill Road and high tension line easement.)
The Commission agreed not to consider this parcel due to a previous vote to not release donated parcels.

Peg explained that exchanging Commission owned property is something that the Commission would not advocate on their own. She stated that the Commission held this meeting with the Planning Board to consider the proposed land swap as a possible alternative to the 40B issue.
Greg asked Eli for an update regarding the Gobbi Property on South Main/South Walpole Streets.
Eli responded that he believes Mr.Gobbi has an agreement with Intoccia to construct approximately 500 homes on the 100+ acres. Mr. Gobbi is moving forward with his original proposal for 250 homes to be built in the back portion of the property as part of Phase I of the construction plan. Phase II of the original construction plan is proposed at the front section of the property.
Eli believes that the following housing mix is being considered for Mr.Gobbi’s project:
9 Apartment type housing is proposed in the back section of the site.
Single Family homes.
Condos.
Age qualified housing.
Eli said that Intoccia has already purchased some of the abutting properties to the proposed project site.
Eli described some of the possible construction scenarios for the Commission:
Intoccia is amenable to build as many apartment type houses as the Planning Board suggests.
Intoccia may also plan to build commercial type properties along South Main Street.
      (Proposed M.U.O.D. zoning would allow for apartment type housing on top of the commercial        buildings.)  
Janet stated that subsequent to the Intoccia meetings she has attended, it is her opinion that he may not be interested in building apartment type homes for this project.
Jane Desberg explained to the Commission that the copy of the Affordable Housing Plan presented to the Selectmen on 5/31/05 is not etched in stone, it is an alternative to the 40-B issue. June 15 is the target date for the Town to submit the Affordable Housing Plan to the State. The Town has one year to implement some of the information that is presented in the Affordable Housing Plan. Jane will provide the Commission with a copy of the Affordable Housing Plan submitted to the State.
Eli requested that the Commission continue their review of the map of parcels proposed by the Planning Board in and effort to identify more lots for the land swap.

Peg stated that the Commission has not made a determination to exchange any of their parcels discussed in this meeting.
The Commission agreed to continue their dialogue with the Planning Board regarding their land swap proposal.

8:30 p.m., N.O.I. Public Hearing filed by Joseph Daly for the proposed demolition of an existing
fire  damaged house and reconstruction of a similar dwelling with a new Title V septic system
 at 53 East Street:

Present:  Stephen Gray. Applicant Joseph Daly. Engineer Dave Oberlander.
Engineer David Oberlander appeared before the Commission to represent the Applicant. He submitted green abutter cards and a Site Plan entitled, “Reconstruction of existing dwelling and subsurface disposal system at 53 East Street, Sharon MA.” Dated 5/4/05.
Applicant Joseph Daly explained to the Commission that he and Stephen Gray are proposing to
purchase the 53 East Street property subsequent to obtaining a building permit for the proposed project.
David Oberlander explained to the Commission that the location of the proposed project is within the 125’ Buffer Line to the delineated wetlands on the site. The adjusted groundwater level is 261.0, which coincides with the edge of the wetland area. An existing wetland area is associated to a brook that is located 38’ from the back left corner of the house.  The location of the proposed septic system is outside of the 50’ Buffer Zone.
David Oberlander explained the scope of the proposed project to the Commission:
·       To demolish the existing fire damaged house and reconstruct a similar house using the
same footprint for the foundation.
(To square off the two existing porches and construct a one level structure above the existing porches.)
·       To pump out the existing cesspool and fill it in with sand.
·       The proposed installation of a new conventional type Title V septic system.
·       Two curb cuts are proposed for the installation of a horseshoe type driveway.
·       The hay bale installation is proposed along the existing open space area of the site.
·       No major clearing of trees is proposed.
The Commission requested the following:
·       The removal of the concrete slab under the porch for the proposed project.
·       The excavation work for the proposed project cannot be stored on the property or near the wetlands on the site.
Peg called for a motion to issue the Order of Conditions per submitted plan pending receipt of the DEP File Number.
