Conservation Commission
Meeting
June 30, 2005

Peg Arguimbau Chairman, Stephan Glicken, Katherine Roth, and Peter Holden were the members present.

7:45 p.m. RDA Public Hearing filed by TEC Associates for the approval of the Resource Area Delineation  and the vegetation control program proposed for the Amtrak Railway right-of-way:

The Applicant was absent from the hearing due to a traveling conflict.
The Commission determined that the boundaries for the resource areas for the proposed project were not depicted on the submitted vegetation management control program.
Peg called for a motion to continue the hearing until Greg informs the Applicant of the Commission's request to delineate the wetlands and to accurately depict the wetlands on a map.
Stephan Glicken moved. Katherine Roth seconded. Voted. Unanimous. 4-0-0.

8:05 p.m. Old/New Business:

Greg explained to the Commission that Gregor McGregor has revised his contract proposal to include a litigation scope of work.
Gregor McGregor was amenable to Greg's suggestion to meet with him and Peg along with the Chairman from the Board of Selectmen and the Chairman from the Zoning Board to review legal options available to litigate unacceptable 40-B proposals.
It was suggested in McGregor's proposal to raise before the Zoning Board the issue that a 40-B Application cannot override Home Rule By-laws. The issue of Home Rule By-laws is not mentioned in Chapter 40B.
This has never been challenged in court.
The Commission agreed to review the information folders provided by McGregor relating to groundwater protection and the Town's infrastructure so that the Commission can begin to address the Housing Plan proposal.

Peg explained to the Commission that the Selectmen hired Camp Dresser and McKee to conduct a survey of the Town's water supply and environmental quality issues. Peg stated that it might be possible to include a component for groundwater protection in that particular survey.

8:10 p.m. Executive Session:

Peg called for a motion to enter into Executive Session to discuss land negotiations:
Katherine Roth moved. Peter Holden seconded. Voted. Unanimous.

8:15 p.m. The Commission unanimously voted to adjourn from Executive Session.

8:20 p.m. Approve Past Meeting Minutes:
Peg called for a motion to accept the June 27th Meeting Minutes as presented.
Katherine Roth moved. Stephan Glicken seconded. Voted. 3-0-1.

Peg called for a motion to accept the June 27th Executive Session Meeting Minutes as amended.
Stephan Glicken moved. Katherine Roth seconded. Voted. 3-0-1.

8:25 p.m. Signatures:
The Commission signed bills. The Commission signed Certificate of Compliance for 16 Townsman Square.
