Conservation Commission
Meeting
September 22, 2005

Peg Arguimbau Chairman, Stephen Cremer and Janet Dunlap were the members present.
Hank Langstroth arrived at 8:05 p.m., and Stephan Glicken arrived at 8:15 p.m.
No Quorum at this time
8:00 p.m., RDA Public Hearing filed by Mass Highway for the proposed resetting of an existing 12” flared end drainage structure and restoration of an eroded slope on Rte. 95:
Tom McGuire, District Environmental Engineer from Mass Highway Department appeared before the Commission and presented the following documents: Drainage Sketch Rte. 95 in Sharon, dated 9/1/05.

8:05 p.m., Quorum - Hank Langstroth arrived.
Tom McGuire stated to the Commission that the drainage structure proposed for repair work is located on Rte. 95 Southbound, 400’ north of South Walpole Street in Sharon. A BVW associated with an intermittent stream is located to the west of the site. He explained to the Commission that the previous drainage improvement project was completed several years ago when road improvements were being made to Rte. 95.
The project involved directing the water flow from two catch basins located within the 100’ Buffer to discharge into a 60” headwall of a cross culvert. The discharge from the culvert flowed onto the adjacent slope and away from the intermittent stream before emptying into the wetland areas on the site. The culvert was installed too high up on the slope and not enough filter fabric or large enough stone was used for the project. A large section of the slope eroded and collapsed into the intermittent stream.  The following is the scope of the proposed restoration project:
·       The installation of hay bales and/or silt fence for erosion control along the limit of work.
·       Excavation of erosion material out of the intermittent stream.
·       Clean out the debris in front of the culvert.
·       Rebuild the drainage outlet and the eroded slope with heavier stone and filter fabric.
The Commission requested that the following conditions be included in the Negative Determination:
   For the Applicant to contact the Conservation Administrator before starting the project for  permission to access the fenced area on South Walpole Street.
·       The use of small track equipment is required due to the steepness of the slope.
·       The removal of 150’ of silt and sand that has migrated into the wetlands.
·       To install extra riprap around Basin #63 & #75 to alleviate erosion on the slope.
Peg called for a motion to close the hearing and to issue a Negative Determination subject to the conditions that the Commission discussed with the Applicant.
Hank Langstroth moved. Stephen Cremer seconded. Voted. Unanimous. 5-0-0.

8:15 p.m., RDA Hearing continuance filed by the Walpole Country Club for the proposed replacement of the drainage system, located on the second hole of the fairway, which no longer functions properly:
Steve Lindberg, Foreman from the Walpole Country Club and Mark Gagne, Golf Course Superintendent appeared before the Commission and submitted the following documents: Plan of Walpole Country Club – proposed replacement of 2 drains on Hole 2, dated 7/26/05. U.S.G.S. Locus Map depicting Walpole Country Club, dated 7/9/04. French Drain Detail, dated 1/22/00. Mark Gagne explained to the Commission that the Walpole Country Club proposes to improve access to the second hole of the fairway in consideration of the golfers and golf carts as well as for routine maintenance equipment. The Walpole Country Club is requesting to replace two existing drain lines that were originally installed in 1975 when the golf course was built. The two drain lines are now clogged and ineffective. The drain lines are located within the 100’Buffer Zone to a BVW on the site with a portion of the drainage system located within 100’ of Spring Brook.
The following is the scope of the proposed project:
 The installation of hay bales and silt fence along the perimeter of work.
To replace approximately 300 linear feet of two existing french drain lines in the fairway of Hole #2.
The installation of two vegetated settlement basins at the edge of each of the new drain lines. (Approximately 2 ½’ deep bermed settlement basins bottomed with sod and blue grass.)

The Applicant proposes to haul all of the excavation work from the project site to an upland area located on the Walpole side of the golf course.  
The members of the Commission agreed to accept the proposed plan as submitted by the Applicant.
The Commission determined to issue the Negative Determination with the condition that all excavation work is completed outside of the 100’ Buffer.  
Peg called for a motion to close the hearing and to issue a Negative Determination as per submitted plan subject to the condition that the Commission discussed with the Applicant.
Stephan Glicken moved. Hank Langstroth seconded. Voted. Unanimous.

8:30 p.m., Request to buy Conservation Land for the installation of a heated swimming pool at 8 Weyman Lane, Mark and Kathy Friedman:   

The Commission reviewed the proposed plan in the absence of the Friedman’s. Peg explained to the members of the Commission that she advised the Friedman’s they could seek a sideline setback special permit from the Zoning Board and that their request to buy Conservation Land for the proposed project was not likely to be granted by the Conservation Commission.

8:35 p.m., Signatures:
The Commission signed bills. The Commission signed a Negative Determination for Mass Highway for their project to reset an existing 12” flared end drainage structure and restoration of an eroded slope on Rte. 95.  The Commission signed a Negative Determination for the Walpole Country Club for their project to replace the drainage system, which no longer functions properly, on the second hole.

8:40 p.m., Other Business:
              -Community Preservation Committee Appointee:
               Peg expressed her interest in serving on the Community Preservation Committee
                during the first term for the benefit of historical projects.
            Janet Dunlap made the motion that Peg Arguimbau be the Conservation Commission’s official
                appointee for the Community Preservation Committee.
            Janet Dunlap moved. Stephen Cremer seconded. Voted. Unanimous. 5-0-0.

               -Pending 40-Bs:
                The Commission reviewed following potential 40-Bs:
Simpson Housing -
     Rte. 1 and Old Post Road - 250 units on less than 4 acres. (75% of the units proposed for rental apartments).
Intoccia – Approximately 200 acres for potential development:
     Norwood Street -
    104 units multi-housing (awaiting eligibility from the State followed by the
      Board of Appeals).
     Gobbi parcel across from Shaw’s - Approximately 250 units.
Avalon Bay- Approximately 156 units proposed for development.
Greg presented a memo to the Commission recommending the formulation of a committee to revise the Town’s Plan for Affordable Housing that was recently denied by the State.
Janet expressed her opinion that the Town’s Affordable Housing Development should not be concentrated on just one or two parcels.
The members of the Commission agreed to review and respond to Greg’s memo as soon as possible.
