Conservation Commission
Meeting
December 1, 2005

Peg Arguimbau Chairman, Katherine Roth and Stephen Cremer were the members present.
Stephan Glicken arrived at 8:00 p.m.
No Quorum at this time
7:45 p.m., N.O.I. Public Hearing continuance filed by Noah Siegel for the installation of a seasonal dock at 54 Lakeview Street. DEP File# SE-280-463:
Noah Siegel appeared before the Commission and stated that a standing type dock has been installed for this project subsequent to his addendum to the original Notice of Intent filed with the Commission in January 2005. He explained to the Commission that the standing dock would provide more stability versus a floating dock and have less impact to any Rare and Endangered Species Habitat existing in the area of the project site.
Quorum, Stephan Glicken arrived.
Greg explained to the Applicant that the Commission could not issue an Order of Conditions for this filing until the freshwater mussel survey on the subject property requested by Natural Heritage has been completed.
The Commission is also interested in obtaining information pertaining to the presence of wildlife species existing along the wetland area of the project site.
Noah stated that he has received estimates from qualified aquatic biologists to conduct the survey. The estimates vary between $300.00 - $500.00.
The Commission and the Applicant discussed the possibility of requesting other property owners who have moorings along Lake Massapoag to share in the cost of the survey.
The members of the Commission determined that the mussel survey would be part of a joint project
between the Commission and the Applicant.
Noah agreed to contact Greg with the name of a biologist to conduct the freshwater mussel survey
during the Spring of 2006.
Stephen Cremer expressed his appreciation to the Applicant for continuing this effort.
Peg called for a motion to continue the Hearing until the Applicant contacts the Conservation Administrator with the name of a biologist to conduct the mussel survey required by Natural Heritage.
Stephen Cremer moved. Katherine Roth seconded. Voted. Unanimous.

8: 10 p.m., N.O.I. Public Hearing filed by Ari Schwartz for the proposed construction of a 28,000 sq.ft.Addition   to the Striar Hebrew Academy with associated parking, utilities and landscaping      100 Ames Street:
Present: Ari Schwartz, Applicant. Jim Devellis and Scott Landgren from Geller and Devellis.
Abutters/Interested persons were also present. (See attached list).
Scott Landgren submitted revised plan dated 11/28/05 to the Commission. He explained that the completion of the proposed addition depends upon the availability of funds. The Applicant is planning to meet with the ZBA to address the elevation calculations of the building among other details of the proposed project.
The infrastructure, the redesign of the parking area, septic system, grade work, curbing and drainage is proposed for Phase I of the project. Only the drainage and grade work is proposed inside the 100’ Buffer Line. The grade work for the construction to remain at rough grade until the addition is completed.
The following list of proposed revisions was made to address the issues of the Commission and the abutters to the proposed project:
The redesign of the paved area of the rear parking lot is reflected on the revised plan. It has
been moved outside of the 50’ Buffer Line.
The installation of an additional stormceptor fronting Ames Street is included on the revised plan. (Sheet LR-1).
113 parking spaces are proposed on the revised plan. (117 parking spaces on the previous plan)
Additional trees are proposed along Ames Street, Cottage Street and Robin Road to provide
screening for neighboring properties.

A present abutter inquired if a construction schedule is proposed for Phase I as well as a snow removal plan for the project.
Scott responded that a construction schedule would be submitted to the Commission after the Applicant meets with the ZBA.
Peg requested that erosion control measures be in place before the start of construction of the proposed project to protect the neighboring properties from flooding.
Abutter Charles Marks, 11 Robin Road – Inquired if a drainage analysis has been prepared for the proposed project. He stated that any changes in the elevation of the proposed project might increase the groundwater level and cause flooding to occur onto his property as well as other neighboring properties.
Peg suggested that a scope of the entire project plan might be obtained when the Applicant meets with the Zoning Board.
Jim DeVellis responded that the drainage flow from the proposed project site would travel into three different directions: Robin Road, Ames Street and Cottage Street before discharging into the wetland areas off-site. A curved design curbing with catch basins and piping are proposed to be installed so that the water flow would meter around the site and prevent flooding to the neighboring properties.
Abutter Pasqualino Pannone, 7 Robin Road- Expressed his concern pertaining to the proposed planting plan if there are not enough available funds to complete the project. He also expressed his concern regarding the possible negative impact to the leaching field of the septic system on his property from the construction of the proposed project.
A present abutter inquired as to the type of trees proposed for the project.
Scott stated that Austrian Pine Trees are proposed for screening along the properties adjacent to the project site.
Peg requested that the proposed planting plan for the project include native type trees and shrubs.
The Commission determined that the Order of Conditions state the following:
For the Applicant to contact the Conservation Commission Administrator before the start of
work to inspect the installation of haybales for the proposed project.
The proposed planting plan to include native type species of trees and shrubs.
The Commission shall approve the required snow management plan.
Any modifications to the final approved site design and/or construction sequencing requires
Commission approval.
Due to the small size of the off-site BVW, this filing is regulated under the Sharon Wetland Protection by-laws only.
Peg called for a motion to close the hearing and to issue the Order of Conditions with the special conditions discussed by the Commission.

8:35 p.m., For the Commission to close the N.O.I. Hearing continuance filed by Thomas Altieri for the proposed construction of a single family house, driveway and retaining walls on land identified as Map 118/Lot 4, Assessors Plat Book, Norwood Street, opposite Cobbler Lane:

Present: Thomas Altieri, Applicant. The Attorney for the Applicant, Joel Fishman.
The Attorney for the Applicant submitted a copy of revised plan dated 11/28/05 to the Commission.
The following changes/additions were reflected on the revised plan to address the concerns of the Commission:
Additional erosion control measures to be placed around the limit of work for the proposed
project.
Rip-Rap is placed around the spillway at the base of the driveway.
The revision to the retaining wall.
A Wetland Replication Plan and a Planting Plan are outlined on the revised plan.

The Attorney for the Applicant presented to the Commission a copy of a filing for Conservation Restriction encumbering approximately 2.73 acres of Lot 4 that is pending Form A approval from the Planning Board.
This Restriction shall be recorded prior to the sale of the lot no later than 3/1/06.
The Attorney for the Applicant also presented to the Commission a copy of a Declaration of Restrictive Covenant. (To be exempt from filing an individual water quality certification permit and to limit the disturbance to the wetlands for the proposed project to 5,000 sq. ft.)
The Commission requested that the document be revised to read as follows:
“Declarant is exempt from having to obtain an individual water quality certification permit for the lot comprising the property if the Declarant imposes upon said lot a restrictive covenant limiting to less than  5,000 sq.ft. the amount of wetlands, said wetlands being defined under 310 CMR 10.00, which may be removed, filled, dredged or altered.”
The Applicant’s Attorney agreed to comply with the Commission’s request to revise the document.
Following the final revision, the required Declaration of Restrictive Covenant shall be recorded prior to the sale of this property and any work associated with the Order of Conditions.
The Commission determined that the Order of Conditions state the following:
For the Applicant to contact the Conservation Administrator before the start of work for the
proposed project.  
The installation of erosion control measures to be in place before the start of construction.
The Conservation Administrator shall be contacted prior to commencement of the wetland
replication.
The replication shall be supervised and monitored by a qualified wetland scientist approved by
the Conservation Commission.
Annual monitoring reports by a qualified wetland scientist shall be submitted to the
Commission
through the second growing season after completion of the wetland replication, and thereafter
until at least 75% of required number and species of plants have survived.
Peg called for a motion to close the hearing and to issue the Order of Conditions to the Applicant pending receipt of the DEP File Number and for the Applicant to contact Greg about the time frame of the recording of the Declaration of Restrictive Covenant.
Stephan Glicken moved. Katherine Roth seconded. Voted. Unanimous.

9:00 p.m., Old/New Business:

The Commission discussed the construction of the Hunter’s Ridge project on North Main Street. Greg explained to the Commission that he has visited the project site on many occasions and established that the Applicant has complied with the Commission’s Order of Conditions. There is no indication that the Developer has cleared beyond what was permitted by the issuing authority of the Planning Board.
