Minutes of Meeting
June 9, 2003
A meeting of the Sharon Board of Health was called to order at 7 P.M. on Monday evening, June 9, 2003, in the Sharon Town Offices, with the following members in attendance:
Chairman Anne Bingham, Vice-Chair Elizabeth Barnett, M.D., Susan Peck, Jonathan Goldberg, and Andrew Stead.
Proposed Revision of Article 7
The Board continued to review proposed changes to Article 7 and set a public hearing date for June 30th at 7:30 P.M.
Len Simons – for Striar Hebrew Academy
Mr. Simons presented a typed copy of the consent order, which was approved by the Board on May 2lst. The Board suggested a change in wording of the Penalties paragraph ---- Mr. Simons will provide a clean copy to the Board as soon as possible for the Board to execute.
Mr. And Mrs. Davidson - 595 Bay Road
Mr. And Mrs. Davidson appeared before the Board at the suggestion of Joe Kent and Jim Andrews, to request relief from the BOH/ZBA requirement for an automatic upgrade of their cesspool to allow for the addition of a three season porch. It was reviewed that a porch with screening and a roof is considered a habitable addition because it is easy to winterize. The Davidsons were unsure as to whether or not their system involves a cesspool or a septic tank. In addition, Board members suggested that the homeowners ascertain whether or not they require ZBA approval for this addition, i.e., whether or not theirs is a non-conforming lot. In reviewing zoning maps, Suzi Peck determined this area is one acre zoning. Also, Anne Bingham questioned the meaning of the phrase in Article 7 “...substantial modifications”. The Davidsons, who have a 5 bedroom home, currently have a small deck — they plan to simply screen it in – put a roof on it — will not heat it or put in windows or use it during
the winter.
VOTED: (Bingham/Peck) unanimously that the Board advise 595 Bay Road that, provided the proposed porch is not heated; has no windows; is supported only by pile foundation - and is not used as a bedroom – and the modification can be made without going to the ZBA for approval...then the provisions of Article 7.02.14 do not apply . Proper building permits must, of course, be obtained. The applicant is advised that the installation of windows would constitute an increase in habitable space and, therefore, a Title V upgrade would then be required.
Suzi Peck agreed to contact Jim Andrews upon his return on June 16th, and Joe Kent to further discuss the issue. She will then contact the homeowners.
Roberta A. Kirshner - Applicant for Licensure as Therapeutic Massage Therapist
Mrs. Kirshner appeared before the Board to apply for a license as a therapeutic massage therapist to travel to the homes of clients in Sharon. She hopes to eventually find a location to set up a massage establishment in town, but will return to the Board at that time. The Board reviewed her credentials and found them to be satisfactory.
VOTED:( Barnett/Peck) unanimously to grant Ms. Kirshner a license to practice therapeutic massage in Sharon at the homes of clients.
Approval of Minutes of Meeting - May 21, 2003
VOTED: (Peck/Bingham): unanimously to approve the minutes of May 21, 2003.
Meeting Dates :
The Board will meet on the following dates: June 30 at 7:30 PM; July14 and August 11 at 7 P.M., with a tentative additional date of August 25th at 7 PM, if needed.
Annual appointments
VOTED: (Bingham/Barnett) unanimously to approve the following annual appointments through June 30, 2004:
Jim Andrews - Health Agent for Engineering
J. L. Lapuck - Health Agent for Sanitary Inspections and Enforcement
Sheila Miller - Assistant Health Agent for Sanitary Inspections and Enforcement
Horizons for Youth
The Board agreed to extend the deadline previously given to Horizons for Youth for presentation of an update of their “master plan” for septic replacement. Linda Rosen will request that plans be provided to the Board prior to the June 30th meeting; the Board will meet with Lori Morency of Horizons for Youth at the meeting of July 14, 2003.
Camp Gan Israel - Request for separate swimming area at Camp Gannett
The Board reviewed the request from the Chabad Center for a separate swimming area for Camp Gan Israel at Camp Gannett. Board members questioned whether or not Concom approval would be required (re wetlands and waterways licenses) and were concerned because the Chabad mentioned “clearing the beachfront and raking clear the swimming area”. The Board will notify Chabad that they must first go to Concom for approval and provide the BOH with a response Concom. If Conservation approves, then, with a list of minimum requirements from the BOH (discussed by the Board), the Board of Health agrees that Camp Gan Israel can have their swimming area and docks.

VOTED:(Peck/Bingham)unanimously that the owner be ordered to have a Title V done on the property within 30 days of date of receipt of this letter, provided the last sale took place since 1995.
Serge Wisotsky — Underground Tank Testing Requirements
The Board agreed to again notify Mr. Wisotsky of the requirements of the Underground Tank regulation as they relate to testing....and to provide him with 30 days to have a precision tank tightness tank performed.
