November 3, 2003
A meeting of the Sharon Board of Health was called to order at 7:05 P.M. on Monday evening, November 3, 2003, in the Sharon Town Offices, with the following members in attendance: Chairman Anne Bingham, Vice-Chair Elizabeth Barnett, M.D., Suzi Peck, Jonathan Goldberg, and Sherwin Goodblatt.
Kindercare Notice to Parents
Anne Bingham reviewed the draft letter from Kindercare and stated that appropriate information was not included in this notice. She suggested that the Board direct Condyne, Inc., to address the notice with Kindercare.
Minutes of Meeting of October 20, 2003
VOTED: (Bingham/Peck) Bingham, Peck, and Barnett voted to accept the minutes of the meeting of October 20, 2003, as amended. Goodblatt and Goldberg abstained.
Variance Hearing - 182 Pond Street
Kristine Meaney of Toomey-Munson and Associates presented a request for variances from Title 5 and Article 7 for the property at 182 Pond Street, owned by Leslie Amper. (This hearing was continued from September 29, 2003.) Also present was contractor Alan Watterson from ATW, Inc. Suzi Peck noted from the materials presented that the JET system being proposed is about half as effective as the FAST system at removal of BOD, TSS, etc. Alan Watterson noted that the JET system is completely below grade and is much quieter than the FAST system. He stated that he has seen complaints about blower issues, noise, etc., with the FAST system. Suzi Peck indicated the board had not heard of any complaints about noise. Mr. Watterson also noted that the JET costs about $l600 to $2000 less than the FAST
system. Kristine Meaney quoted from DEP documents that the JET does remove 88% of BOD, TSS. She also noted that the JET system is newer, so there is less data available. Anne Bingham asked for additional information, i.e., to assess the FAST system in comparison to the JET system. Suzi Peck said she will discuss with Jim Andrews whether or not there have been complaints received regarding the noise level of the FAST system...and she will review the product literature to compare the 2 systems.
Following further discussion, and at the urging of Alan Watterson, in order to expedite the matter, Ms. Amper agreed to have a FAST system installed......the blower will be placed as far away from the house as possible; some minor drawing changes will be needed, but, basically, the plans will remain the same.
VOTED: (Bingham/Peck) unanimously to approve the variances requested in the letter from Toomey-Munson dated August 29, 2003, including installation of a FAST system (instead of a JET system) at 182 Pond St. with the following conditions:
1. Revised plans are to be presented to Jim Andrews for his approval;
2. A notice (to be approved by the Board of Health chairman) of restrictions imposed on the use of the septic system must be recorded at the Registry of Deeds as condition of the grant of title certification;
3. A signed O&M agreement to be provided to the BOH, with the following testing requirements: BOD, TSS,
PH, TKN, Ammonia, and Nitrites; System must remain under maintenance agreement, with pumping in
accordance with manufacturers’ requirements and annual report to the BOH;
4. Water conservation devices required, including low-flow toilets, faucets, and showerheads;
5. Any new owner must be provided with a copy of the variance and conditions;
6. No mercury switches allowed;
Variance Hearing - 188 Pond Street
Kristine Meaney of Toomey-Munson and Associates presented a request for variances from Title 5 and Article 7 for the property at 188 Pond Street....the estate of Joseph Simonetti.
VOTED: (Peck/ Bingham) unanimously to grant the variances requested in the letter from Toomey-Munson dated October 21, 2003, including installation of a FAST system (instead of a JET system), with the same conditions as listed for 182 Pond St. In addition, approval is contingent upon Jim Andrews’ agreement that the plan presented shows maximum depth to groundwater going to the existing treeline.
Horizons for Youth
Lori Morency, Executive Director of Horizons for Youth, was present, along with William R. Buckley, P.E. of Bay Colony Group, Incorporated, as well as a representative from the Board, to report on progress towards development of a master septic plan, Anne Bingham will review with Bret Rowe (DEP) the gallons per day to be used in sizing the system. Lori Morency noted that they’re at least a year away from developing a master facilities plan, in terms of the funds to be raised. She stated there are 27 buildings on a 50 acre lot....and they have no intention to expand beyond the current programming. Horizons will most likely be doing an incremental building plan. Horizons will return in March/April of ‘04 to update the BOH.
41 Brook Road - Variance Request
Jim Miller, P.E., Miller Engineering, along with homeowners Mr. And Mrs. Schoenfeld, was in attendance to present a request for variances from Article 7 for the property at 41 Brook Road. A sieve analysis was done -- Class 3 soil found . A 25% reduction of the size of the field is requested, in order to protect the landscaping.. Board members expressed concern since there have been other problems in this neighborhood (Glendale and Brook Roads) due to the poor soil and high water table..... and were unlikely to allow the reduction unless a greater level of treatment were also provided. After discussion, the Schoenfelds agreed to add a FAST system.
VOTED: (Peck/Bingham)unanimously.... to approve a FAST system for this location, with the same requirements as listed above for the 2 properties on Pond Street......revised plans to be approved by Jim Miller prior to construction.
Update - Shaws’ Plaza.
Jeff O’Neil and Irv Frankel of Condyne,Inc., Rich Riccio of Field Engineering, and Bob Field of Field Engineering, as well as the L.S.P. for the site, were present to update the board on progress at the site in the 4 months since Condyne, Inc., purchased the property. Mr. O’Neil noted that Shaws/Brooks has a long-term lease until 2054. He further noted that, in determining the GPD, they removed the freezer space of l5,000 square feet from the calucations. With the bottom-line figure of 9655, the GPD would be under the 10,000 GPD which would necessitate application to DEP for a groundwater discharge permit. The Board asked that an alternative treatment system be considered....with pathogen treatment....and a deed restriction..and that Condyne return to the BOH for
further discussion.
In addition, at Anne Bingham’s request, the L.S.P. will contact the corporate attorney of Kindercare regarding appropriate notification to the parents on the Notice of Responsibility received.....notice should be informative, but not unduly alarming.
Jay and Karen Schwab – Sweethearts Three
Jay and Karen Schwab, along with Attorney Peter Alpert, returned to the Board to report that the proposed candy business falls under the SIC Code 5441. The Board was satisfied that the business does not fall into a category where discharge to a septic system is prohibited, and approved the business for the proposed location at 24 Pond Street. The Schwabs will schedule an appointment with the sanitarian.
VOTED:(Peck/Bingham) unanimously that the Board has no jurisdiction, i.e., no impediments or requirements, to the establishment of a proposed driving school at 59 Pond Street, Suite B, to be operated by Gilli Glukhovskaya.
VOTED: (Peck/Bingham) to accept $363 in donations to be deposited into the “Health Clinics Donation Account” to be used for future health promotions.
Proposed FY05 Board of Health and Uncontrollables Budget
The Board reviewed and approved these budgets for presentation to the Finance Committee. It was noted that all scenarios to be presented are, in actuality, “minus” budgets, since the level-funded budget allows for a 3% salary increase, but does not provide any additional funding for this increase.

VOTED:( Bingham/Peck) Bingham, Peck, Goodblatt, and Goldberg voted to accept the minutes of the meeting of September 29, 2003. Barnett abstained since she left that meeting before it concluded.
The meeting was adjourned at 9:45 PM.
