Minutes of Meeting
February 23, 2004
A meeting of the Sharon Board of Health was called to order at 7:15 P.M. on Monday evening, February 23, 2004, in the Sharon Town Offices, with the following members in attendance: Chairman Anne Bingham, Vice-Chair Elizabeth Barnett, M.D., Jonathan Goldberg, and Sherwin Goodblatt. Also in attendance were Jim Andrews, Health Agent for Engineering, and Linda Callan, Administrative Assistant to the Board of Health.

VOTED: (Goodblatt/Goldberg) unanimously to accept the minutes of February 9th, 2004, as amended.
“Landscaping your Septic System”Jonathan Goldberg provided this brochure received from a Sharon resident..The Board discussed providing some of this information through public education, as well as a potential future review of the issue of pumping within Article 7.
Blood Drives
The Board reviewed information regarding scheduled blood drives in Sharon. Following an inquiry by Selectmen Grasfield, Linda Rosen, corresponded with the American Red Cross and has made arrangements to provide advertising for these drives (to be held at various temples and churches in town) on the town website and cable t.v.
Shaws’ Plaza septic update
Irv Frankel of Condyne, Inc.,(property management), Jeff O’Neil, manager of Sharon Investment Partners LLC and representing Condyne, Inc., and Bob Field, P.E. of Field Engineering were in attendance to review plans for the septic repair for Shaws’ Plaza.. An existing 13000 gallon tank will remain — a 9000 gallon tank with FAST system plus a 3000 gallon tank with FAST are proposed...along with 3 uv systems.....and upgrading pumps in the existing pump chamber.
Jim Andrews noted that the soils in the test pits are good - pure sand. It was stated that, if the soil is found to be significantly different than that of the test pits, the Engineering Department shall be immediately notified.
Jeff O’Neil explained that the property was transferred to the current ownership in June 2003, and that the system then failed Title V. He will provide the office with a written record of ownership.
Jonathan Goldberg raised the issue of a need for backup power in case of a disaster. Mr. Field reviewed that more than half the flow is from the cinemas, which wouldn’t be running in the case of a disaster...and they have 24 hour backup capacity.
The Board also noted that they will be instituting annual fees for those systems granted variances with reporting and testing requirements in order to assist the Board with monitoring such requirements. The fees have not yet been set, but $100 per year is under consideration for residential systems.
VOTED: (Bingham/ Goodblatt) unanimously to approve the plans for the upgrade of the septic system serving Shaws’ Plaza as reflected in the application dated 2/13/04 subject to the following restrictions:
1. Prior to issuance of the permit, the owners of the property must provide a full description of the current form of legal ownership.
2. The owners retain maintenance staff with sufficient knowledge of the workings of the Fast - uv systems - Zabel filters and alarms.
3. A signed O&M agreement to be provided to the BOH, with the following testing requirements: BOD, TSS, PH, TKN, ammonia, and Nitrites.
4. System must remain under maintenance agreement with pumping in accordance with manufacturer’s requirements.
5. Quarterly report to the BOH, including a general, comprehensible narrative on how well the system is running .
6. No mercury switches allowed.
7. The permittees agree that any time a new tenant is proposed, they will review the list of design flows for the entire facility and ascertain that the new tenant will not bring design flows above 10,000. (This information will be Included in quarterly reports.)
8. If the soil is found to be significantly different than that found in the test pits, the Engineering Department shall be immediately notified.
9. The notes on the plan will be changed to reflect “commercial usage” rather than “residential usage”.
10. An annual fee, to be set by the Board, will be paid to the BOH for monitoring these requirements.
11. Notice of restrictions imposed on use of system to be recorded at Registry of Deeds as condition
of the grant of title certification.
12. Any new owner must be provided with a copy of the approval and conditions.
37 Pond St. Variance Request
Dave Oberlander, P.E., was unable to attend. The applicant, Mr. Hui, was in attendance, along with 2 abutters from the Delapa property at 47 Pond Street. Jim Andrews reviewed that the plan presented is the best that can be done.
The abutters expressed concerns about trespassing during construction, with the proposed the system being only 5' from his property line. Mr. Hui said the access for construction equipment will be from another property he owns on the other side of this property, as well as from his South Main Street property. He also commited to pump the tanks daily while construction is ongoing. He agreed to post signs about parking restrictions on the adjacent property. Mr. Delapa suggested a bond in case damage done to neighbors’ property....BOH regulations allow setting financial assurance requirement for large construction, if so desired. Anne Bingham stated this may be included in the decision, as well as a deadline as to when construction should be completed, e.g., 6 months. There will be no raise in
grade of parking lot. Mr. Hui was advised to begin to seek a bondable contractor.
The hearing was continued to March 8th at 8 PM when Mr. Oberlander will be present.
Septic Variance Revolving Fund
The Board began a discussion of fees to be imposed for all septic installations requiring variances, upon which reporting and testing requirements have been placed and need monitoring. Members discussed and will consider whether or not a third party will be needed to do the work — both onsite field work(appointments would need to be scheduled to inspect/review when service is provided), as well as administration (i.e., collection of funds and development of a database to keep track of fees and monitoring requirements).
Animal Regulations and Massage Regulations
Linda Callan has contacted all of the towns on the list of comparable towns to provide us with copies of their animal regulations and massage regulations. Elizabeth Barnett will review these. She also suggested that references should be collected for any applicant for a massage license.
