Board of Health Minutes 04/12/2004
                                                

        
A  meeting of the Sharon Board of Health was called to order at 7:20 P.M. on Monday evening, April 12, 2004, in the Sharon Town Offices, with the following members in attendance: Chairman Anne Bingham, Vice-Chair Elizabeth Barnett, Jonathan Goldberg, Suzi Peck, and  Sherwin Goodblatt.  Also in attendance was Jim Andrews,  Health Agent for Engineering.

Metal Bellows
Don Myers of Norwood Engineering had previously called to cancel the appointment scheduled to modify the existing permit for Metal Bellows, since the owner plans to subdivide the property. Their attorney, however, said it was strictly a zoning issue and didn’t require BOH approval. Anne Bingham will review the history of the 21E at DEP. Jim Andrews noted that the DPW has no plans on record for the existing building, which dates back to the 70's...and that they intend to calculate the design flow by actual use and water records.  According to Jim Andrews, there will be only sanitary sewerage....no industrial waste. The Board asked that a letter be sent to Mr. Myers, with a copy to the ZBA, requesting discussion of the septic system issue at the next meeting - May 12th.


37 Pond Street - Continuation of Variance Hearing
David Oberlander, P.E., was present to respond to questions from the Board. The Board reviewed a letter from Allen Hui, property owner, suggesting several options.  Suzi Peck noted that Title V provides for the option of a mini-treatment plant to be established for adjoining properties.  David Oberlander noted, and Jim Andrews agreed, that it would be best to keep the restaurant separate, due to the grease issue. Suzi Peck suggested an easement allowing them to use some of the adjoining land for leaching field. In Mr. Hui’s letter, he stated that an easement would be problematic.  Sherwin Goodblatt suggested that a deadline be placed on the project.

VOTED: (Peck/Goodblatt) unanimously to approve the plans, with variances requested, with a deadline of 90 days for project completion.  In addition, the following requirements were voted:

1.  Occupancy of restaurant to be reduced to 100 seats ---- revised occupancy permit to be provided to Board of Health.
2.  Both tanks to be pumped on a monthly basis, at a minimum.
3.  A weekly check of tanks to be conducted by a designated, qualified person to ascertain whether or not  tanks need to be          pumped more often; log to be maintained; copy of log to be provided to Board of Health on routine basis.
4.  Evidence of contract with a grease hauler to be provided to Board of Health.
5.  Signs to be posted during construction notifying patrons not to park on neighbors’ property.

(A less frequent pumping schedule may be proposed if suggested to be appropriate by the grease hauler.)

Following the discussion and vote, Mr. and Mrs. Hui appeared at 8 P.M. (They thought the appointment was at 8 PM). The vote was explained to them and further discussion took place.  Mr. Hui stated that he would not be able to have the work done within 90 days.  David Oberlander also agreed that to have the project completed within 90 days would be difficult. The Board then reconsidered the deadline and......
VOTED: (Bingham/Goodblatt) unanimously to amend the prior approval to allow the project to be completed by
August 31, 2004.

Hollister Siegmund....Siegmund Environmental Services
Mr. Siegmund was present to provide information to the Board on the DEP-approved Singular Wastewater Treatment System developed by his company. The Singulair replaces a septic tank.....has only one moving part (electric motor) and requires pumping every 3 years on average, with the filter cleaned annually.  There are approximately 140 such units in Massachusetts now. During the first year, the system is sampled and inspected quarterly.  A two year contract is provided, regardless of whether or not the home is sold. Anne Bingham asked Mr. Siegmund to provide data on those systems which have been in the ground....as well as on denitrification systems.

Mel Leventhal - 7 Robin Road
Mr. Leventhal, realtor David Nelson, and David Oberlander, P.E., were  present to request future approval of a Singulair Treatment system for his property.  The house has been sold.....system is in failure. New owner has one year to replace the system. .Mr. Leventhal apologized for the late request for this appointment, but he and his wife were just accepted to an out of state assisted living facility and they will need to upgrade the system in order to sell the property. The home has two bedrooms....a 1500 sq. foot house on a 20,000 square foot lot. Engineer David Oberlander stated that the owner will
probably return to BOH for reduction in separation to groundwater. He envisions a Singulair unit, pump chamber, and leaching field....will be approximately 50 feet from wetlands. Jim Andrews agreed that an I/A will be required for this type of situation.  Anne Bingham said the system is approvable by BOH, since it is DEP-approved; however, the BOH may attach additional restrictions.  The new owner will have to agree with maintenance requirements, as well as a notice on the deed that there is a Singulair system installed, with quarterly monitoring required. Anne Bingham emphasized that the Singulair does not mean that the house can be expanded (# bedrooms) Jim Andrews noted that he has told the new owner, the current owner, the real estate agent, as well as Dave Oberlander, P.E., that they should not anticipate that the house may be expanded following installation of the alternative system. In addition, Suzi Peck stated that the Board is not allowing depth to groundwater reductions with new construction.

VOTED:(Bingham/Goldberg) unanimously to accept the minutes of March 22, 2004.

Inspection of properties
Suzi Peck suggested, and the Board agreed, that the Board should require septic inspections for large properties if there has been no transfer of ownership/no inspection since 1995, as was recently done with Saphire Manor.   Jim Andrews reviewed the properties which have either upgraded or had inspections recently, and it was determined that the only properties fitting into this category (requiring inspection) are the De Lapa properties on Pond Street and the Needle property (Heights Plaza).
        
Lake Sampling
The Board reviewed a memorandum from Eric Hooper in which he stated that the DPH can no longer handle the lake sampling. Suzi Peck stated that the funding has never been in our budget...we do not have the expertise or staff available to handle this....that historically this has been absorbed by DPW staff.  Board members agreed this is a high priority public health issue which must be taken care of quickly.......or DPH will not allow us to open the beach for swimming. Board members agreed that a memorandum should be sent to Ben Puritz seeking his advice..noting that it is the priority of the town to maintain the health of the lake.  

Pooper Scooper Law
Sherwin Goodblatt suggested that a pooper scooper regulation or bylaw be investigated.  Linda Rosen will provide information previously gathered on the issue.

Massage Regulations  Elizabeth Barnett had reviewed a number of communities’ massage regulations and found those of the Newton Health Department to be the most comprehensive. Linda Rosen will try to get a PDF file from Newton; Elizabeth Barnett will adapt this to Sharon’s needs and email it to other Board members for review.
