A meeting of the Sharon Board of Health was called to order at 7:20 P.M. on Monday evening, September 27, 2004, in the Sharon Town Offices, with the following members in attendance: Chairman Anne Bingham,
Sherwin Goodblatt, Elizabeth Barnett, M.D., and Suzi Peck. Also in attendance was Jim Andrews, Health Agent for Engineering.
Walter Newman ... ZBA/BOH mutual concerns
Walter Newman was present to review with the BOH whether or not it would be useful for the town to incorporate nitrogen removal systems as a requirement for additions in water protection districts. It was reviewed that residents located in a Zone II who are expanding habitable space ,but not seeking a variance from Article 7 or Title 5, must go to the ZBA, which then requires they upgrade to the 1995 Title V. Suzi Peck noted that the BOH does not allow increase in flow when a variance is required. Board members encouraged Mr. Newman to urge the ZBA to use the BOH definition of bedroom in its determinations. Board members felt this is the more pressing issue.
Future mutual issues to be discussed include the ZBA rule of no more than 6 gallons of loading per 1000 square foot of lot size in water protection district. Suzi Peck noted the DEP requirement (from the 95 code) of an acre of land for 4 bedrooms in a Zone 2.
Anne Bingham stated the requirement of a nitrogen removal system addition may be appropriate in the water protection districts — but can’t counterbalance the addition of bedrooms (whether considered computer rooms, exercise rooms, bedrooms, etc). Suzi Peck said it is upto ZBA to look at plans after Jim/BOH oks septic system in accordance with # of bedrooms. Then ZBA should determine whether plans are in compliance with BOH definition of bedroom. And, therefore, back up BOH regulations. Walter Newman stated he was in agreement.
Hunter’s Ridge - Frank Gallagher, PE - Discussion
Mr. Mirrioni, developer, Frank Gallagher, P.E., and a number of abutters were present for discussion of a proposal for a shared septic system with two disposal areas, under a special permit under the Conservation Subdivision Bylaw, which allows for retirement housing. 49 single family homes plus a duplex are planned, along with a community center and swimming pool. The parcel runs between Huntington Avenue and Lantern Lane, at 157 N. Main St. Each unit to have 2 bedrooms: 1400 sq. feet to 2100 square feet; a few may have basements. There will be a homeowners’ association. Planning Board approved 26 conventional units (4 bedroom homes) for this location. DEP requirement of 150 gpd for retirement units. Peter Okane is addressing drainage issues; hydrogeological study ongoing.
Abutters expressed concerns and questions regarding: soils found in test pits (Jim Andrews stated there are very good soils there); flooded basements in the area and the potential affect of tree removal (being covered through Conservation Commission); whether the shared system is an improvement over prior proposals; question of setback requirements for shared system vs. an individual system.
Discussion to continue on October 25th at 8 PM: Per BOH request, the applicant to bring the following:
water records from similar Mirrioni development(s) in Easton;
sample floorplans;
plans approved by Planning Board;
copy of hydrogeological study (when available);
Map showing section of topography;
Summary of soil logs
Review /discussion will include comparison to a wastewater treatment plant.
Lexus Dealership Proposal - Continued
Richard Merrikin, P.E., of Merrikin Engineering and Joel Fishman, Attorney at Law, regarding proposed car dealership at 15 and 55 General Edwards Highway. System was redesigned to 9800 gpd; will be floor drains; ; floor cleaning will be contracted out -- all wastewater will be removed offsite. Just under 100 employees and 100 customers/day. No industrial waste, including service bay waste,service bay cleaning, and car wash waste shall be disposed of in the septic system....such waste to go into a holding tank.
Elizabeth Barnett left the meeting at this point.
VOTED: (Goodblatt/Peck); Goodblatt, Peck, and Bingham voted in the afformative to approve the plans dated 7/29/04, as amended 9/20/04, for a septic system to serve a Lexus Dealership at 15 General Edwards Highway, with the following conditions:
Hazardous waste to be disposed of in accordance with state requirements (314CMR30);
Nothing except sanitary waste, as defined in Title V, shall be disposed of in the septic system;
Outside of the bays no cars shall be washed with anything other than clear water.
The Board encouraged the applicant to continue actively pursuing tieing into the Walpole sewer system.
10 Atlas Road and 6 Atlas Road
Jim Andrews and Linda Rosen reported on a property line dispute and request for hearing from Mr. and Mrs. Carley of 6 Atlas Road. The hearing was scheduled for October 25th; Jim Andrews will continue holding the permit for the septic system at 10 Atlas Road until the hearing.
Sharon Dog Park: handling of dog waste
Board members expressed concerns about the trash disposal plans for the dog park. It was agreed to ask members of the Dog Park committee to come in to discuss on October 4th.
