A meeting of the Sharon Board of Health was called to order at 7:30 P.M., in the Sharon Town Office Building, with the following members in attendance: Anne Bingham, Chair, Elizabeth Barnett, Vice-Chair, Suzi Peck, Sherwin Goodblatt, and Stanley Rosen.
Minutes of Meeting.
MOVED ( Bingham/Peck) Bingham,Peck, Barnett voted in the affirmative; Rosen abstained...to accept the minutes of the meetings of September 12, 2005, October 25, 2005, November 12, 2005, and November 28, 2005. The Board also reviewed the memorialization of the meeting of September 26, 2005, for which there was no quorum.
Monitoring of septic variances
Linda Rosen will continue to bring requests to the BOH on an individual basis until the department has developed a system to keep track of testing results. Linda Callan is working on a spreadsheet for this purpose.
Vote to accept donations
(VOTED)(Bingham/Barnett)Bingham, Barnett, and Peck voted in the affirmative; Rosen abstained...to accept $100 in donations received for the purpose of defraying the cost of future flu clinics and other health promotions .....and to deposit these funds into our “Health clinics donation account”.
Food Service Permits for non-municipal/non-profit organizations...Linda Rosen suggested a half-price fee for non-municipal/non-profit organizations—for an annual food service license. The proposed annual fee of $75 (vs. the regular fee of $150/year) would require a hearing following 3 weeks of advertising on cable television. Following discussion, it was decided to postpone scheduling a hearing on this item.....to be discussed again on January 9th. Suzi Peck expressed concerns about the BOH imposing burdensome requirements on churches, temples, etc....for instances when cooking does not take place on the premise. Linda Rosen noted that DPH does require that all such institutions be licensed....if any advertising of events (in any form) takes place. She suggested
that the Health Department would hold another program (such as was held early in 2005) to educate people involved in non-profit organizations regarding the proper handling of food. She noted that every licensee would be required to have at least one person certified via the SERVSAFE program (which provides a 5 year certification) and that that person should be educating others.
Norwood Engineering....John Rhoads, P.E., and Keevan Geller, property owner, were present for an informal discussion to propose elimination of the lumber business at 216 North Main Street and conversion to 6 additional one bedroom condominiums in addition to the 3 bedroom facility which is already there, resulting in greater flow. Suzi Peck noted that a variance was previously issued by the BOH in 1997 to allow development of the 3 bedroom townhouse at this location, despite reservations of the BOH at that time. Variances would be required for additional development and : property line setback and wetlands setback; the existing FAST system would have to be replaced. Anne Bingham stated that it was the Board’s consensus that it would be extremely unlikely that the BOH would grant variances
for new construction.
Mr. Geller stated he may consider expanding the facility for milling/lumber, etc., or may go the 40B route.
32 Beach Road - Continuation of Variance hearing
David Oberlander, P.E., and Joanne Craig, owner/applicant....
Discussion of requirement of U/V system (since concerns re contaminating the lake) vs. additional separation. Board reviewed prior variances in the area...consisting of small lots where construction of a retaining wall might have been necessary and could cause additional problems Board agreed that, in this situation, the owner could go with 5' depth to groundwater and a standard system, if so desired. The owner was presented with several options and will make a decision within a week, at which time the Board’s variance decision letter will be prepared.
VOTED (Bingham/Peck): Bingham,Peck,Barnett voted in the affirmative; Rosen abstained.....to approve any of the following alternatives outlined, once Jim Andrews has approved the plans:
1) 3.5' separation with an I/A system and UV treatment, and all the standard BOH conditions, including a deed restriction to no more than 3 bedrooms, low-flow toilets, etc.,
2) or 4' separation with an I/A system ...NO UV treatment, and all the standard BOH conditions, including a deed restriction to no more than 3 bedrooms, water conservation devices, etc.
3) or 5' separation with a conventional system, i.e., standard Title 5 technology, with water conservation devices.
21 Beach Road - continued variance hearing
David Oberlander, P.E., and Joseph Daly, property owner, provided historical information from the Building and Engineering Departments indicating prior approval of the home as a 2 bedroom,
The variances requested were reduction of the wetland setback from the leaching area to 86+ feet. In addition, a variance is required for building in fill.
VOTED: (Bingham/Peck) Bingham, Peck, and Barnett voted in favor, Rosen abstained, to approve the plans for the property at 21 Beach Road dated October 6, 2005. A deed restriction will be required for the property....it will be restricted to 2 bedrooms. In addition, water conservation devices will be required, including low-flow toilets, faucets, and showerheads. The Board also urged that, when the existing washing machine needs replacement, a water-saving front-loading washer replacement be considered.
Massage Regulations
The Board continued its review of the draft massage regulations. Linda Rosen and Elizabeth Barnett will continue working on these. Changes in fees will be proposed January 9th....then a hearing will be advertised on cable television for 3 weeks and all licensed practitioners will be notified of the hearing date (tentatively to be February 6th).
