A meeting of the Sharon Board of Health was called to order on Monday, March 27, 2006, at 7:30 P.M., in the Sharon Town Office Building, with the following members in attendance: Anne Bingham, Chair, Sherwin Goodblatt, and Suzi Peck. Jim Andrews, Health Agent for Engineering, was also present.
Beach Closure Policy/Lake Testing Locations
Following a review of the last four years’ lake test results, Suzi Peck recommended that the lake testing protocol remain the same. It was the sense of the board to maintain the status quo re test locations and frequency.
Regarding the beach closure policy:
VOTED: (Bingham/Peck) Bingham and Peck voted in favor...Goodblatt abstained....for the following policy re closure of the Memorial Beach:
1. If only the boat landing area results are elevated....the Memorial Beach will not be closed;
2. If only the swimming docks area tests high....the Memorial Beach will not be closed;
3. If the concession stand or boat landing side of the beach test sites are elevated, it will be at the discretion of the staff (with consultation with the BOH only if deemed necessary) as to whether or not to close other areas of the beach.
Minutes of Meeting
VOTED: (Goodblatt/Bingham) unanimously to accept the minutes of the meeting of March 13, 2006.
Requests for reduction of testing
Suzi Peck directed that testing of alternative systems may be reduced (following 2 years of successful quarterly testing) if BOD is under 30 ppm; and solids are 30.
Variance Request: 76 Massapoag Avenue
Claudia Krug.P.E., of WindRiver Environmental continued the variance request for 76 Massapoag Avenue.
Jess Talbot, homeowner, was also present and questioned the size of mounding. There was some discussion of evidence of high groundwater in past history.
VOTED: (Bingham/Peck) unanimously to grant the variances requested in the letter dated March 2, 2006, as reflected on the plans dated 1/4/06 ...amended 3/2/06. Conditions: use limit to 4 bedrooms to be recorded at Registry of Deeds; annual pumping; install low flow toilets and/or appliances upon replacement.
17 P.O. Square
Jim Miller, P.E., presented proposals for a septic system for Dunkin’ Donuts for the location at 17 PO Square. He reviewed discussions he had with Brett Rowe of DEP. This is new construction/increase in flow/change in use....minimum flow for a fast food restaurant = 1000 gallon per day (i.e., 50 seats)
The 1st option presented (1000 gpd) would need state variance for distance from street and building.....if BOH approves; would also need a setback variance from Article 7.
The 2nd option ... designed at 820 gallons/day ..meets all Title 5 setback requirements....but would need variance for maximum daily flow. (Minimum for fast food restaurant = 1000 gpd.)
Suzi Peck asked whether all possible water-saving measures e.g., composting toilets, very low flow toilets, extreme water-saving devices, etc., had been considered, so that the flow would not be greatly increased. Anne Bingham felt that 1000 gpd might actually be a conservative figure. Mrs. Cavallo stated that there are no plans to bake at this location. Currently the design flow is approximately 300 gpd. Suzi Peck noted that this is truly new construction; that the only way the BOH might be able to grant variances would be if the flow could be kept as low as possible. It was stated that the existing Sharon store at Shaws’ Plaza runs at 1100 gpd. Anne Bingham asked for ways to reassess the daily flow...using comparable stores...to determine the estimated actual wastewater flow.
Ben Puritz was present to note that Jim Andrews had suggested looking at possibly tying into Pizzigando system, using a pump system. Pizzigando’s system had 455 gpd actual metered usage for the last six months; it is sized for 1895 gpd...placed into service in 1996. This tie-in would need permission from the property owner, Phil Papadopolous. 19 seats are planned for Dunkin’ Donuts (per Title 5 = 20 gpd/seat). Pizzigando was originally designed for 54 seats. Anne Bingham encouraged looking at this option of a shared system (which will need state approval)....she stated that any flow greater than 300 gpd will present problems in terms of variances from both the local BOH and from DEP. Suzi Peck noted it will come down to a seat count.
Ben Puritz stated, and Michael and Diane Cavallo concurred, that Dunkin’ Donuts needs some direction....a time frame....in order to continue seeking this option. They have been paying $5000/month rent to RRM Realty, which holds a long term lease on the property. No change in ownership is planned.
Anne Bingham stated that the Board needs some basis to believe that as complex a situation as this will work; needs some confirmation of access to the existing system, i.e., results of discussion with property owner of Pizzigando. Discussion was continued to April 10th at 8:30 P.M.
Striar Hebrew Academy
The Board reviewed a response from Striar Hebrew Academy and will prepare a letter extending the deadline for use of the Clivus toilets to September 30, 2006.
Water flow - 3-10-12 P.O. Square
The Board will request that the property owner place individual sub-meters on both
Starbucks and Coriander Bistro to help determine how to reduce the flow in order to maintain the system.
