September 25, 2006
A meeting of the Sharon Board of Health was called to order on Monday, September 25, 2006, at
7:35 P.M., in the Sharon Town Office Building, with the following members in attendance: Elizabeth Barnett, Vice-Chair, Suzi Peck, Stan Rosen (arrived late), and Jay Schwab. Jim Andrews, Health Agent for Engineering, was also present.
Hearing re proposed change to Article 7 (Septic Regulations)
Elizabeth Barnett opened the hearing at 7:45 PM.....
Suzi Peck explained that the state code, Title 5, recently removed the requirement that the Sharon BOH now wishes to include in Sharon’s local regulations (Article 7). Suzi Peck stated the rationale: that Sharon requires more stringent regulations in that, unlike most communities, we rely almost completely on septic systems, but we are densely developed; we rely on public wells for our drinking water The proposed change would include the provision that any application for a shared system must include the demonstration that 2 separate systems in compliance with Article 7 and Title 5 could have been constructed. The new provision would go into effect 30 days following publication in the Sharon Advocate. Responding to a question from Jim Andrews, the Board agreed that all plans currently “in the pipeline” would be grandfathered.
VOTED: (Barnett/Peck) Barnett, Peck, and Schwab voted to approve the change to Article 7. (Rosen was not yet present.)
Variance hearing: construction in fill...Bill Matt...13 Drake Circle
Bill Matt presented information on this proposed system (new construction). Conservation Commission review is also required. Applicant will return with further explanations from wetlands expert. Setback variances; other variances may be needed with redrawn plan. Suzi Peck noted the strict requirement for loss of all economic benefit to the property. Applicant requested continuance (indefinite).
George Saba 292 Old Post Road; Miller Engineering.
Mr. Saba has a functioning cesspool for an existing single family home. He received special permit from ZBA to remove dwelling and replace with new dwelling. No variances needed - fully compliant system.
Mr. Saba would like to continue to live in house for a period of time during construction..upto 4 months; proposed tight tank on temporary basis; existing septic would be cut off with installation of tight tank until house is live-in condition. Mr. Saba would monitor water readings; would schedule pumping when reach 750 gallons; visual inspection to be done every other day; low flow showerheads; no clothes washers to be used while tight tank in use; anticipates pumping every 10 days.
The board agreed that this unusual request requires a hearing. Suzi Peck noted that usually construction takes longer than expected; would probably be more expensive than anticipated; maintaining lifestyle of living on a tight tank will be difficult. Stan Rosen stated that, from public health perspective, he does not want to set precedent of approving temporary installations, particularly for strictly convenience, economical, and comfort concerns. Mr. Saba decided to forego the hearing and move out of the house during the construction period.
Todd Pilling: Pilling Engineering: discussion of proposed shared system: 229 North Main St.
The current owner of the 5 bedroom single family home is willing to give up 2 bedrooms in the existing home....to create 2 homes: 1 with 3 bedrooms; 1 with 2 bedrooms. Suzi Peck noted: 2 families using 2 homes do not use the same amount of water as one larger family in one home. The applicant agreed to make the system a 6 bedroom system (660 gpd), but agree to a deed restriction to 5 bedrooms for the 2 homes; no variances to be required from the state; new construction for 2nd house – could be done without variances from the town. Approval hearing (no variances) to be held on October 16th on proposed shared system: 3 abutters to be notified ; to bring revised, updated plans, DEP documents, floor plans for existing home and both proposed homes; to require deed restrictions; not to be
in fill; easement agreement; lot to be created prior to October 16th. (All documents to BOH by October 10th).

Glendale Village Proposal
Jim Andrews provided a list of variances required from Article 7 for the proposed Glendale Village 40B.
Earthtech (peer reviewer) has not yet provided a letter to the ZBA/BOH.....expected to provide later in the week. It was agreed to hold an additional BOH meeting on Tuesday, October 3rd, to review this issue and provide comments to the ZBA prior to their hearing on Glendale Village currently scheduled for October 11th.
The meeting was adjourned at 9:55 P.M.
