August 27, 2007
A meeting of the Sharon Board of Health was called to order on August 27, 2007, at 7:40 PM, in the Sharon Town Office Building, with the following members in attendance: Anne Bingham, Chair, Elizabeth Barnett, Vice-Chair, Jay Schwab, and Stan Rosen. Jim Andrews, Health Agent for Engineering, was also present.
Proposed meeting schedule: Oct-Dec. 07
The Board agreed on the meeting schedule for October through December.

VOTED: (Bingham/Barnett) unanimously to accept the minutes of the meeting of July 23, 2007.
Michael LeBlanc re: Proposed geo-thermal well for 190 Norwood Street
Anne Bingham reviewed the DEP Watershed Management Policy on Regulatory Requirements for Closed Loop Geothermal Heat Pump Wells, Policy Number BRP/DWM....and stated that, since the town has no additional requirements, Mr. LeBlanc’s proposal should be approvable if he complies with the DEP policy. Mr. LeBlanc, an architect, who has utilized this methodology in projects in other states, explained that this well will allow him to heat and cool his home without use of oil or gas. This would be a sealed system - standing column boring geothermal well. All water is recirculated .... does not affect the groundwater. The location of the boring is about 80' from leaching system. Stan Rosen asked that the applicant provide written proof of compliance with #s l-5 of the DEP policy....as well as
compliance with 3l3 CMR 3.00.
Underground Tank Permit Request: Herb Chambers Lexus Dealership
Joel Fishman, Attorney, Richard Merritt, P.E., and the owner of Commonwealth Tank.
To discuss underground storage tank for gasoline. No Zone II; No Groundwater Protection District;
Selectmen need to issue permit to fill the tank; Fire Chief would need to issue permit to store fuel in the tank. BOH needs to issue permit for tank. Maintenance requirements of Article 15 were discussed. In addition, Jay Schwab asked for clarification of the procedures for responding to the tank alarm in case of any leaks, e.g., who would be responsible to respond if the dealership were closed over a holiday weekend.
VOTED: (Bingham/Rosen) unanimously to approve the installation of the tank upon receipt of a statement from the installer that they have read and understood Article 15 and intend to comply completely......and will immediately notify BOH with any information of leaks. Also, a signed copy of the letter from Luis Diaz, Project Manager, is to be sent....before permit will be issued.
Massapoag Yacht Club - Request to rebuild bathrooms
Randy Rubenstein, Treasurer. Existing bathrooms are falling apart. Membership is capped at 70. Toilets are used mainly June - September and part of October. Leaching field was installed in 1993.
Yacht Club wants to double the number of toilets....but will not increase membership. System was pumped last week and report was adequate. Anne Bingham expressed concerns about adding toilets so close to the lake. Stan Rosen suggested that the applicant have a Title 5 inspection completed...and report/return to the BOH. Anne Bingham strongly recommended consideration of installation of foam-flush toilets or, at a minimum, low-flow toilets, i.e., discharging greywater. Applicant will return to the BOH on September 10th.
Change in use hearing: 435 N. Main St.
Joel Fishman, Attorney, Jim Miller, P.E, Michael Fillion, P.E., and Ina Rabinovich, property owner...presenting plans to demolish the existing single family house and to construct a new building from which she will operate a child day care facility. This was a 4 bedroom home: maximum design flow - 440 gpd. Design flow requested = 450 gpd. Joel Fishman reviewed the state law regarding day care facilities, MGL CH 40A:3. He stated that normal zoning doesn’t apply. Jim Miller stated that the system is in compliance with Article 7...treated the plan as new construction, although it is not technically new construction. Jim Andrews: reserve area must be enlarged to 644 square feet. No variances are required.
Applicant to return to ZBA September 19th, although no special permit can be required (by statute).
A number of neighbors were present to express concerns. Debbie Pittman had concerns about the proposed elevation of the septic system; also, concern about access for pumping of the system. Jim Andrews saw no problem about servicing the system. He also saw no problem about pumping up the hill. Jim Miller stated there will be no mound. Trees will need to be removed. 4 test pits were dug. Anne Bingham expressed concerns about the design flow: no design flow about 440 will be allowed. The kitchen is in question as far as flow is concerned.
VOTED: ( Bingham/Barnett) unanimously to approve plans dated 8/17/07provided the Board receives revised plans showing no more than 440 gpd and receives a clarification statement regarding the kitchen not being an issue, and enlargement of reserve area if necessary.
