Minutes of Meeting October 6, 2008
A meeting of the Sharon Board of Health was called to order on October 6, 2008 at 7:30 PM, in the Sharon Town Office Building, with the following members in attendance: Stanley Rosen, Chair, Ed Welch, Vice-Chair, Jay Schwab, and Anne Bingham. Also present was Jim Andrews, Health Agent for Engineering.

Animal Regulations
Stan Rosen asked the board members to carefully review the draft regulations for discussion at the next meeting.
Anne Bingham requested that Ed Little be asked if there’s anything in the draft Foxboro regulations that we’re missing in our draft regulations.
Stan Rosen reported that Suzi Peck (who is ill tonight) will be sending information to the board members re P.O. Square Redevelopment Committee plans/consultant report re 2 potential locations for wwtp. .for further discussion.
Discussion: LIP application - Residences at Sharon Commons/Villages at Sharon Commons Present: Marie Cannon (Earthtech) ; Bob Shelmerdine; Jesse Moreno of Coler and Colantonio.
Overview and history of the draft proposal presented to the Selectmen was presented. This is the second phase of the project (first phase was lifestyle center)...and was noted in the original MOU in 2007. 30 townhouses (condominiums), 100 apartments (4 stories), and 38 condominiums (3 stories) are planned....all with no more than 2 bedrooms each. Sole public access to be from South Main St. 35,000 gpd wwtp for the apartments, condos, and townhouses ; separate 65,000 gpd for the lifestyle center. LIP application to come from BOS.
Bob Shelmerdine explained that, in order to design the wwtp to serve all the units, there are certain aspects of Article 7 with which they cannot comply....they can comply fully with Title 5. He stated that, in the instance of the 40B (LIP), the ZBA issues the permit (with advice of the BOH). There are waivers in the comprehensive permit process which the ZBA may grant. If the 40R process (A smartgrowth initiative) is followed (both processes are being followed at the same time...40R will be voted on at November 17th Town Meeting), local rules and regulations are not bypassed....you must comply with both state and local rules....no waiver mechanism in 40R. ZBA would remain permit-granting authority, but the BOH would also be a permit-granting authority. They would
need to request variances from BOH from Article 7 with the 40R.
Jesse Moreno: At this point, would need to request waivers: from 100' offset to approximately 20' from structures and property line to treatment works; from 6 minute per inch (perk rate) requirement. These are 2 main waivers..there may be others.
