Minutes of Meeting

May 13, 2009

A meeting of the Sharon Board of Health was held on May 13, 2009, beginning at 7:30 P.M. at the Sharon Town Office Building, with the following members in attendance: Chair Stan Rosen, Vice-Chair Andrew Stead, Suzi Peck, and Jay Schwab.  Also present was Jim Andrews, Health Agent for Engineering.

Minutes
VOTED: (Schwab/Stead) Schwab, Stead, and Rosen voted to accept the minutes of the meeting of April 6, 2009, as written.  Peck abstained.

Lake Sampling:
VOTED: (Schwab/Stead) unanimously to appoint Peter Blumenthal as an agent of the Board of Health for the purpose of drawing lake samples...appointment to expire September 5th, 2009, following appropriate instruction by BOH staff.

Variance Hearing: 25 Meadow Road
Present:  Tracy Sharkey - Guaranteed Builders and Bill Drexel - N.W. Engineering, on behalf of property owner  Truong Tran.
Mr. Drexel  presented newly revised plans (not previously provided to the BOH)  following a meeting with Conservation Commission. He met today with Greg Meister, Joe Kent, and Jim Andrews  to try to devise a plan amenable to Concom, ZBA, and BOH regulations. Footprint is not exactly the same as existing.  Maximum feasible compliance.  Several variances are required, including sideline setback, mounding.  Plans for renovated house are being drawn..and will be provided to BOH ASAP.  Expansion area doesn’t meet setback requirements of Article 7.  Suzi Peck suggested they do not show a reserve area on plans (allowable for maximum feasible compliance);  proposed size of house (current and proposed = 3 bedrooms) has been reduced.  BOH Decision would require low flow toilets, etc. Applicant to obtain maximum separation possible; Jim Andrews stated the soil is excellent.  The Board stated it would grant conceptual approval...pending receipt of plans...and clarification of variances;  deed restriction would  go with property that there could be no more than 3 bedrooms; need letter specifying all variances.  
Mr. Drexel will provide revised septic plans and architectural drawings for the BOH to review on June 1st.  Hearing continued.  Applicant does not have to reappear before the BOH.

Animal Regulations
The Board reviewed several incongruities in the draft regulations and agreed to make appropriate changes.   Since the proposed new fee had been advertised, and “late” fees remain at $25 and $50, it was agreed there was no need to advertise such late fees. It was also agreed to add a statement “...the BOH may not issue a permit unless it has determined that the applicant is in compliance with Article 13 or the BOH has issued a variance pursuant to 13.13...” The Board will review the revised draft on June 1st.

Water reports
Andy Stead expressed concerns about elevated sodium levels at well #4.  It was agreed to ask Dave Masciarelli to investigate and recommend remedial action.....and suggested that a request to Amtrak be made to use less sodium chloride/more calcium chloride on the railroad tracks.
