SHARON BOARD OF HEALTH
November 2, 2009
A meeting of the Sharon Board of Health was held on Monday November 2, 2009, at 7:30 PM at the Sharon Town Office Building. In attendance were Andy Stead, Vice-Chair; Jay Schwab; and Ed Welch. Also present was Jim Andrews, Health Agent for Engineering.
Minutes of October 19, 2009
VOTED: (Welch/Stead) unanimously to accept the minutes of the meeting of October 19, 2009, as amended.
Proposed Meeting Dates
The Board approved the following meeting dates :
November 30th and December 14th - previously approved;
January 4 and 25; February 8 and 22; March 8 and 22; April 12 and 26.
Donations
VOTED: (Welch/Schwab) unanimously to accept donations of $483 received to defray the cost of future flu clinics and other health promotions...and to deposit these funds into the Health Clinics Donations Account.
Ethics Commission
Linda Rosen presented documents from the Town Clerk and Ethics Commission involving Conflict of Interest laws. An online test must be taken by all town employees (paid and unpaid) and a receipt presented to the Town Clerk by 12/31/10.
Vacation time
VOTED: (Stead/Schwab).....unanimously to approve the request made by Linda Rosen to extend 5 days of vacation time to 2010....due to medical reasons.
34 Crest Road Way
Elliot and Marcia Feldman, homeowners, were present for a continued discussion; Plans involve removing one bedroom - changing to walk-in closet; adding a bedroom upstairs. They provided a letter from Bill Traut, who built the system in 1984, in which he stated the system met the code at the time for a 4 bedroom home.; attached as-built of septic system by Link Munson...passed Title V conditionally (the septic tank in garage must be removed..owners agreed to remove). Jim Andrews stated that adding habitable space would normally require an upgrade to the septic system; no sign of failure to date. He stated this is a marginal situation ...system would need to be replaced if the property is transferred. Mr. Feldman: Joe Kent stated that if a door is added to the existing den, Joe Kent would approve as a 3 bedroom
house. Andrew Stead stated that, according to Article 7....if add habitable space and not in groundwater or surface water protection district, the system must meet 78 code...and comply with 7.11.1B. According to Jim Andrews, it does satisfy this section. Andy Stead stated that the Feldmans are actually reconfiguring the space...not adding space..
VOTED: (Stead/Schwab) unanimouslyto approve the reconfiguration of the house at 34 Crest Road Way to maintain the 4 bedrooms utilizing the existing septic system, with the provision that they comply with the removal of the 2nd tank which is located in the garage.
25 Meadow Road
Homeowner Truong Tran and Attorney Joshua Katz.
Variances listed on plans and in narrative stamped October 30, 2009.
Had informal discussions with Greg Meister (Conservation Commission). House now faces street...body of house at 25' from street..still to need setback variances from ZBA. Also still need to go formally before Concom and ZBA. Constitutes maximum feasible compliance.
Voted: (Welch/Schwab) unanimously to approve variances as requested in letter and plan stamped by William Drexel, P.E., dated 10.30.09.....including a Presby (alternative) system for a 3 bedroom house, with a deed restriction for 3 bedroom house to be filed at the Registry of Deeds...pending Jim Andrew’s review....Standard conditions to include a signed annual O&M agreement with sampling required for BOD, pH, TKN, Ammonia, Nitrates; pumping in accordance with manufacturer’s requirements; annual report to BOH; No mercury switches allowed; Water conservation devices required, including low flow toilets, faucets, showerheads, and appliances (washer and dishwasher when replacement is needed.)
