Applicant seeks (i) modification of Paragraph 7 of the “Early Sitework Authorization Decision No. 1609” issued May 14, 2008 by reduction of that amount of security established thereunder; (ii) Approval of a substituted Letter of Credit in the name of Boston Private Bank and Trust Company offered as security pursuant to Paragraph 7 of the “Early Sitework Authorization Decision No. 1609” issued May 14, 2008; and (iii) such other relief and findings as may be necessary or required for those matters specified in (i) and (ii) above.
